Mexico Privacy Notice

Last updated: 13/10/2026

Effective date: 27/09/2026

Convenience translation. This document applies to personal data processed in Mexico. If this English translation differs from the official Spanish text, the Spanish version will control.

Identity and address of the data controller

Pamela Diana Villaseñor Gutiérrez, also doing business as Key Fractional, with an address at Plaza Soriana Mega, Carretera Tepic–Puerto Vallarta 1297, Local 5, C.P. 63732, Flamingos, Bucerías, Nayarit, Mexico, is responsible for processing and protecting the personal data described in this Comprehensive Privacy Notice.

Personal data we process

Depending on your relationship with Key Fractional, we may process:

  • Identification and contact information, such as your name, address, telephone number, email address, date of birth, nationality, marital status, language and photograph.
  • Tax information and identification documents, such as RFC, CURP, tax status certificate, voter identification, passport, driver’s license or immigration document.
  • Corporate and representation information, such as articles of incorporation and powers of attorney.
  • Information relating to real estate, including titles, deeds, trusts, permits, authorizations, certificates, photographs and property characteristics.
  • Information provided through forms, email, telephone, messaging or when scheduling a call.
  • Technical and usage data, such as IP address, device, browser, security logs, cookie preferences and interactions with the site, where processing is permitted.

We do not request sensitive personal data through public forms. If such data is exceptionally required for a transaction or legal obligation, we will explain the purpose and obtain the appropriate consent.

Primary purposes

  • Responding to requests and following up with interested persons.
  • Scheduling calls, visits and meetings.
  • Identifying the persons involved in real-estate transactions.
  • Creating files and verifying documentation.
  • Promoting and marketing properties in accordance with the applicable instructions and authorizations.
  • Coordinating negotiations, visits, procedures and legal acts.
  • Managing contractual relationships and complying with legal, tax and anti-money-laundering obligations.
  • Protecting the security and integrity of the site and preventing abuse or fraud.

Secondary purposes

With your consent, we may use your contact information to send news, informational content, invitations and marketing communications. These purposes are not necessary to provide our services. You may refuse or withdraw your consent by emailing info@keyfractional.com.

Cookies and similar technologies

The site uses cookies that are strictly necessary to operate and manage your preferences. Analytics, advertising and other non-essential technologies will remain blocked until you provide the corresponding consent. You may accept, reject or change your choice through “Cookie preferences” in the site footer. We will also honor Global Privacy Control signals where applicable.

Website chat, WhatsApp and temporary sessions

The website chat is provided by Respond.io. If you choose to continue without sharing contact information, Key Fractional will not use that conversation to follow up with you and will delete the associated temporary record from its systems after the configured inactivity period. However, due to the provider’s technical operation, the conversation history may remain visible locally in the browser or device used even after the record has been deleted from our systems. On shared devices, we recommend using private browsing or deleting the site and chat provider data.

If you voluntarily continue the conversation on WhatsApp, an identified contact associated with the telephone number used will be created in Respond.io, even if you previously continued anonymously in the website chat. Continuing the current conversation on WhatsApp does not by itself authorize future calls, messages or emails; Key Fractional will request and record your follow-up preferences separately.

Service providers and transfers

To operate the site and provide services, we may use hosting, security, consent-management, form, CRM, email, communications and analytics providers. Providers currently contemplated include Hostinger, Enzuzo, HubSpot, Respond.io and Google. Some may process data outside Mexico in accordance with their contracts, notices and lawful transfer mechanisms.

Information may also be disclosed, where necessary or legally required, to authorities, notaries, financial institutions, advisers, service providers, counterparties and other persons involved in a transaction. When a transfer requires consent, we will request it beforehand.

Retention and security

We retain data for as long as necessary for the stated purposes and for applicable legal, contractual, tax or rights-defense periods. It will then be securely deleted, blocked or anonymized. We apply reasonable administrative, technical and physical safeguards to reduce the risk of loss, alteration, unauthorized access, use or disclosure.

ARCO rights

You may request access to, rectification or cancellation of, or object to the processing of your data. You may also limit its use or disclosure and withdraw your consent where legally permitted.

Send your request to info@keyfractional.com with:

  • Your name and a means of receiving notices.
  • Documents proving your identity and, where applicable, your representative’s authority.
  • A clear description of the data and the right you wish to exercise.
  • Any information that helps us locate the data.

We will communicate our determination within twenty business days of receiving the request. If the request is granted, it will be implemented within the following fifteen business days. These periods may be extended where permitted by law.

Competent authority

If you believe your data-protection rights have been violated, you may contact Mexico’s Secretaría Anticorrupción y Buen Gobierno, the competent authority under current federal law.

Changes to this notice

We will publish amendments on this page. Where a change requires new consent, we will request it before applying the relevant processing.
